Waiter Fired For Myspace Blog... *Fake "witness"*
I was recently fired from my job a few weeks ago because of a blog posted on a private account on myspace this was also followed by a conversation regarding joking about messing with food. Meaning that no one except the few select friends on my friends list can view it. The problem arose when i posted a bulletin about bad tippers, and a 17 year old girl who was from a city which is over 50 miles away from my work decided she was going to email,fax, mail* a lie to corporate and send copies of my myspace blog and our conversation which never once mentioned the company i worked for, and had specifically joking commentary which she must have claimed was truthful. along with this lie she claimed that " i had served her and she decided not to tip me because i gave " bad service " and she "sent" corporate a "link" to my myspace page" this being said it was an absolute lie i have never met this girl in my life and there was no way corporate got my myspace unless she had sent it to them, they could not have done it with a link seeing it is private. This girl was on my friends list from a long time ago, i was in a semi popular band over here and she had added me a year or so ago. Anyways i specified to this employer that i had a mental disability(which didn't impair my ability to do the job) about 3 months before i was terminated i came in to work on time and clean and ready to go the DM was there and sat me down and asked me if i knew what she had in her hand. She verified it was copies of my myspace, i was therefore terminated she made references to the conversation i had with the girl through my private messaging meaning it couldn't have been anyone else but her who sent it in. I ended up being featured on the big media station who defended that i was wrongfully terminated on a feature they did. Now im looking into other legal actions. Anyways i have been sending out tons of resumes and filling out applications and for some reason employers are not contacting me back. My father who has muscular dystrophy was laid off a week after i was terminated and now i am going to have to move out on my own seeing that he can't support me anymore. I am in college, housing costs are insane, and i can't find anywhere who pays a living wage but serving...thanks so much for reading the above.
i guess that questions i have for you are:
question is why do employers seem to thrive on turnover?
It seems there are no jobs these days where you can actually have a significant life at without worrying about your job.
the exception is right now im in school to do the medical field which always needs people.
I also went through this corporations HR to appeal the termination and was turned down on all levels of management. I have spoken to some lawyers whom are friends of my parents and they have told me i probably have a good chance of winning a case. The HR for this company i was terminated from assures they have spoken to their lawyers and there is nothing i can do against them. I have received all the files my company had on me almost all of which were positive files, good performance reviews etc...
I won't specify the exact location i worked at due to legality issues, But i can tell you the restaurant i worked for was called "Shari's" a "family" dining restaurant thats located in the northwest although i spent more time serving low income people, drunks, and very rude and ignorant people from specific races who rarely tipped and ordered the most expensive items in the menu.( you can probably guess ). worked there almost a year.
I also want to specify in this message that i do not judge anyone by there race, color, creed, gender, religion or any specific trait that is unique to an individual. What i will tell you is that i do base expectations the experiences i have with specific people and sometimes races based off my consistent experiences i have with them.
Overall i love all people, regardless of how they treat me, and i only wish to make those people who fit into the category of ignorant, selfish, rude aware that their actions very much so affect the people who are working to make them happy.

K, so I got fired for posting a blog on my myspace. I worked for Nordstrom until 3pm instead of 4pm. Why? This coworker of mine was on my friend list on my My-space, which I had set it to private meaning it is not viewable by anyone else who's not on my list.
I posted a blog saying "nappy headed *cunt," which was toward some girls I knew back then, and one of the girls had lived with me for a couple of weeks. Anyway, the coworker on my friend list is African American and felt so offended by the word "nappy headed" on my blog, which is only viewable by people on my friend list, and she decided to gossip about me to another african american/supposely brazillian coworker at work. So now I got two girls against me. They decided to print out my blog, brought it to work, and discussed it to human resource. HR had the nerve to question to whom my blog was directed to, what does it mean, what drove me to write that blog, and if it was not towards the two girls at work, it was aslo very offensive and racist of me to do so privately online, and that I'm termed period. Hr. also said I'm fired not because of the complaint but the fact it got brought to work by a coworker on my page, so that meant that it was work realated. How is that work related? Later Chris the human resource lady said that another manager whom I never met name chris, and her were the ones who made the personal choice to term my position because it was their personal view of my page. I said, well you shouldn't even have seen my page, because it was private, you saw it through people who were gossiping about me to begin with, and people who saw it privately. So where is my free speech that is offered in the ammedmenths. I have the freedom of speech, can have a web page, or publish anything out there as long as if it's not a threat. IT is not for anyone nor you, chris to judge me based upon hearsay and my private page that she should not have seen. Nordstrom had no business in questioniong about my personal life outside of work along with my set to private webpage. So anyway I was terminated for an unlawful reason. She also said, my words were derogatory towards blacks as a common sense, even if it's not in the dictionary, and that My-space is unique and is work related." (Nordstrom does not say it in their work agreement about myspace). She also had the nerve to suggest me to apply for Starbucks and get on unemployment right away. She offered me her business card and said I can even use her as a personal reference to help me get another job. Ha! So I lastly asked Chris Rominger who fired me what's my termination say on her computer, she says "poor performance." What? I thought I got fired because of myspace. Right?
